U.P. RERA gets strict on promoters not giving possession 

• Sanjay Bhoosreddy Chairman U.P. RERA took exception to the Prayagraj Development Authority for not executing the sale deed in the name of 09 of the allottees of its Alaknanda Project even after one year of RERA order.
• He referred all the 09 matters to the court of the Adjudicating officer for ensuring registry and possession of the units using the powers conferred under CPC.
• He has also directed to issue recovery certificates for delay interest from the year 2016 for delay in handing over possession to the allottees.
• Chairman RERA has expressed strong displeasure over the working of the promoter who has not executed the registered sale deeds in the name of the allottees even after the CC of the project.
Lucknow/ Gautambuddh Nagar:  Sanjay Bhoosreddy, Chairman U.P. RERA, while hearing the cases of 09 of the allottees of the Alaknanda Project of the Prayagraj Development Authority on 26-04-2024 for enforcement of the orders passed in March 2023, noticed that the promoter had obtained the C.C. (Completion Certificate) of Alaknanda Project in January 2024. RERA had granted the relief of possession with interest for delay to these allottees in March 2023. However, the promoter had refrained from executing the sale deeds in the name of these allottees even after being provided sufficient opportunity for compliance of the RERA’s orders.  Bhoosreddy expressed strong displeasure on the dilatory tactics of the promoter and referred all the 09 matters to the court of the RERA Adjudicating Officer, who has been a District Judge, for ensuring the registry and possession in favour of the allotees, using the powers conferred under the CPC, promptly.
He further directed for issuing of recovery certificates for payment of interest for delay at the rate of SBI MCLR+1 percent from 2016.
 Sanjay Bhoosreddy vehemently said that non-execution of registered sale deed by the Prayagraj Development Authority in the name of the allottees, who had RERA orders in their favour, even after obtaining the C.C. of the project is not understandable. Furthermore, it is financially detrimental for the concerned development authority as the financial liabilities keep increasing with time. He expected the planning authorities to be prompt in execution of registries and handing over of possession to the allottees. He said that RERA was always there to help the allottees who were suffering because of the acts of omissions and commissions of the promoters.
