U.P. RERA advises sale and purchase only through RERA Registered Agents

• Soliciting of sales and purchase, facilitating bookings and promotion by an un-registered agent is prohibited and a punishable offence.
• The stakeholders, such as the promoters and the home buyers, should buy and sell the apartments or plots or shops only through registered agents and they must confirm the registration no. from RERA portal.
• An aggrieved consumer can file a complaint in RERA, if any agent indulges in sale-purchase on the basis of false and misleading information.
• U.P. RERA has prescribed mandatory training and certification for registration and extension of registration of agents.
Lucknow / GautamBudh Nagar: U.P. RERA, keeping in view the security of the interest of the stake holders such as the home buyers and the promoters, has advised them to make the sales and purchase in real estate project only through the agents registered with RERA. If RERA registered agent provides false and misleading information during such sales-purchase, the aggrieved person has remedy through complaint in RERA against such an agent. U.P. RERA can also appropriately penalize the agents if they are found guilty. Sales and purchase of properties only through RERA registered agents are secure.
Agents have an important role in the real estate sector and a Real Estate Agent is responsible for extending all the services from booking to the registry of the unit, timely and efficiently. Most of the properties are being booked, sold and purchased through the agents and there have been instances of the consumers not taking sufficient care when making investment through the agents and at times they make such investments through un-registered agents in U.P. RERA. Such carelessness may be detrimental for them as they might not have access to any relief against such agent through RERA.
Likewise, it is mandatory for a promoter to give, at the time of application for registration, the list of agents he wants to use for marketing or sale or purchase in his project. Before investing in a project through an agent, an aware consumer should verify the registration number of the agent from the ‘Registered Agent’ page on the UP RERA portal (www.up-rera.in) and the list of agents associated with the project by the promoter.
U.P. RERA, taking into account the above-mentioned scenario, had issued detailed guidelines under the title “Kya Karen, Kya na Karen!” on 22-02-2024 whereby the agents were instructed to must prominently publish their RERA registration number along with the registration number of the project and web link of U.P. RERA, in any promotion or prospectus of a project. The object of these guidelines was to ensure the dissemination of correct information to the consumers, to ensure the accountability of the agents, to improve the working of the agents and to appropriately penalize them whenever they are found guilty.
U.P. RERA has been continuously observing that there is noted deficiency in the skills and sensitivity at the end of the real estate agents and at times they betray the lack of desired commitment towards the consumers. Accordingly, RERA has taken a considered decision that hence forward it will grant registration to the persons and institutions desirous to work as agents only if they have acquired minimum requisite skills and also developed suitable aptitude for this profession. Now RERA has made short-term training and certification mandatory both for registration as an agent and for extension of registration of agents. Any person can verify the particulars of an agent from the REGISTERED AGENT page on U.P. RERA portal www.up-rera.in.
It was stated by Sanjay Bhoosreddy, Chairman, U.P. RERA, “The real estate agents have an important role in the real estate sector. It is of paramount importance that they show transparency and credibility. We are aiming at the introduction of professionalism in the work of Real Estate Agents and, therefore, we have made arrangements for training and certification of agents. We are expecting the stakeholders they will make the sales and purchase in real estate projects only through the agents who are registered with RERA, and they will also verify the registration details of such agents from our website. We are working towards effectively controlling the recklessness at the end of the agents and to improve the security of the investments of the consumers.”
