Call for Gender-Neutral Laws to Prevent Legal Misuse and Protect Families

Lucknow: A recent conference organized by Guide Organization, led by social activist Dr. Indu Subhash, highlighted the rising misuse of marital laws and the urgent need for legal reforms to protect families from unjust persecution. The discussion emphasized how gender-biased laws have led to wrongful accusations, pushing innocent men to legal, financial, and psychological distress—sometimes even suicide.

The issue has gained momentum after incidents such as the Meerut murder case and multiple suicides of men including Atul Subhash, Manish, and Nishant. The speakers asserted that false allegations, extramarital affairs, and marital disputes have led to a severe crisis for men and their families.

Concerns Raised:

Several existing laws—IPC 498A (Dowry Harassment), false rape accusations, the Domestic Violence Act, and maintenance laws—have allegedly been misused, leaving men and their families vulnerable to legal harassment. Many innocent men, unable to cope with the stigma and legal battles, have resorted to suicide.

The conference also addressed the growing cases of brutal murders of men by their partners and the social consequences of increasing false allegations.

Key Demands:

The organization has put forward seven major demands to ensure justice and fairness:

  1. Gender-Neutral Marital and Criminal Laws – Domestic violence, marital disputes, and sexual harassment laws should apply equally to all genders.

  2. Strict Punishment for False Allegations – Those filing false cases should face severe legal consequences.

  3. Police and Judicial Reforms – No arrests should be made without a thorough impartial investigation, and a separate legal body should be formed for marital dispute resolution.

  4. Mandatory Counseling and MediationPre-litigation counseling should be a priority to prevent unnecessary legal battles and mental distress.

  5. Mental Health and Suicide Prevention SupportDedicated helplines, legal aid, and psychological counseling should be provided to men facing false accusations and harassment.

  6. Protection for Senior Citizens – Many elderly parents are victims of misused domestic violence and maintenance laws. The government must shield them from unnecessary legal entanglements.

  7. Establishment of a Men’s Ministry – A separate ministry should be formed to address men’s legal issues, ensuring compensation for victims of false cases, fast-track courts, and rights to child visitation.

Appeal to the Government:

The speakers stressed that justice should be equal for all genders, as the current legal system has ignored the wrongful persecution of men, leading to family breakdowns and suicides. They urged the government, judiciary, and civil society to implement gender-neutral laws to restore balance and protect families from unjust legal action.
