Historic Decision in UP: Daughters to Get Equal Rights in Father’s Property

Lucknow: In a landmark move for women’s rights, Uttar Pradesh is set to grant daughters equal inheritance rights in their father’s agricultural land, including married daughters. Until now, under Section 108(2) of the Uttar Pradesh Revenue Code-2006, only widows, sons, and unmarried daughters were entitled to inherit property, excluding married daughters—a provision long criticized as discriminatory.

According to sources, the proposed amendment will remove distinctions between married and unmarried daughters. Once implemented, daughters—regardless of marital status—will have the same legal claim as sons and unmarried daughters. The revision will also ensure that sisters of the deceased landowner receive equal rights.

This step aligns UP with states like Madhya Pradesh and Rajasthan, where married daughters already enjoy equal inheritance rights in agricultural land. The proposal will now undergo administrative review before being presented to the cabinet, and following legislative approval, it will become law—a major stride toward gender equality and women’s empowerment in the state.
